1. Acceptance of Terms

The Turby Time service (“Turby Time” or “the Service”) is operated by Turbovine Inc. (“Turbovine”, “we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Turby Time is a language and speech learning platform designed for children. The Service provides interactive lessons, speech-based activities, and progress tracking accessible through a family account managed by a parent or guardian.

3. Account Registration

To use the Service, a parent or legal guardian must create a family account. You are responsible for maintaining the confidentiality of your account credentials and parent PIN, and for all activity that occurs under your account. You must be at least 18 years of age to register an account, and you confirm you are the parent or legal guardian of any child profile you create.

4. Children's Privacy

We take the privacy of children seriously. Child profiles are managed exclusively by the parent or guardian account holder. We do not knowingly collect personal information directly from children without verifiable parental consent. Please review our Privacy Policy for full details.

5. Acceptable Use

You agree to use the Service only for its intended educational purpose. You must not misuse, reverse engineer, or attempt to gain unauthorised access to any part of the Service, nor share your account with others. Any conduct that disrupts or interferes with the Service is strictly prohibited.

6. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, characters, audio, video, and software — are the exclusive property of Turbovine Inc. and are protected by applicable intellectual property laws. You may not reproduce or distribute any part of the Service without written permission.

7. Subscription, Auto-Renewal & Payments

Access to the full set of lessons requires a paid annual membership (currently CAD $49 per year, or the then-current price shown at checkout). Payments are processed by our payment provider, Stripe.

Automatic renewal. Your membership renews automatically at the end of each annual term, and your payment method will be charged the then-current renewal price, unless you cancel before the renewal date. By subscribing, you authorise these recurring charges.

Managing and cancelling. You can cancel at any time from the “Manage subscription” area of your parent dashboard. Cancellation takes effect at the end of your current paid term; you keep access until then. We may change pricing for future terms with reasonable advance notice.

8. Cancellation & Refunds

You may cancel your membership at any time as described above. Except where required by applicable consumer-protection law, subscription fees are non-refundable, and cancelling stops future renewals rather than refunding the current term. If you believe you were charged in error, contact us and we will review your request.

9. Promotional Codes

We may offer discounts through promotional or creator codes. Such codes are subject to any stated conditions, have no cash value, and may be modified or withdrawn at any time. Codes may not be combined unless we state otherwise.

10. Educational Purpose; Not Medical Advice

Turby Time is an educational product intended to support language and speech learning through play. It is not a medical device or a diagnostic tool and is not a substitute for professional advice, assessment, or treatment from a qualified speech-language pathologist, therapist, or healthcare provider. If you have concerns about your child's speech, language, or development, please consult a qualified professional.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that may cause harm to us, other users, or children. Sections intended to survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranty of any kind, whether express or implied. Turbovine makes no representations that the Service will be uninterrupted, error-free, or that any defects will be corrected.

13. Limitation of Liability

To the fullest extent permitted by law, Turbovine Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. To the extent liability cannot be excluded, our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless Turbovine Inc. and its officers, directors, and employees from any claims, losses, or expenses arising out of your misuse of the Service or your breach of these Terms.

15. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. The Service is offered worldwide, and you are responsible for complying with the laws of your own country or region. You agree to submit to the exclusive jurisdiction of the courts of Ontario, Canada, except where applicable law gives you the right to bring proceedings in your place of residence.

16. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Turbovine regarding the Service.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the new Terms on this page with a revised date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
